2. Scope and Acceptance

These Terms and Conditions govern access to and use of the website quick-spirits.com, as well as the purchase of products through the online store. By accessing and using this website, the user declares to have read, understood and fully accepted these Terms and Conditions.

The use of this website and the purchase of alcoholic beverages are exclusively for persons aged 18 or over. By making a purchase, the customer confirms that they meet the legal age to purchase alcoholic beverages.

3. Products and Prices

All products available in the online store are subject to stock availability. The prices indicated include VAT at the legal rate in force and are expressed in Euros (€).

Quick-Spirits reserves the right to change product prices at any time without prior notice. However, the prices applicable to an order shall always be those in force at the time of order confirmation.

In case of an obvious typographical error in the price of a product, Quick-Spirits reserves the right to cancel the order, proceeding to the full refund of the amount paid.

4. Order Process

To place an order, the customer must create a user account on the website and follow the indicated purchase procedure. The order shall only be considered confirmed after receipt of full payment.

After order confirmation, the customer will receive a confirmation email with the order summary, including the products purchased, the total amount and the estimated delivery time.

5. Payment Methods

Quick-Spirits offers the following payment methods, processed in a secure environment by authorised and supervised third-party entities:

Quick-Spirits does not store complete credit or debit card data. This data is processed directly by the payment service providers, in compliance with the PCI-DSS standard.

Deliveries are made by the carriers CTT, DHL, TNT, FedEx, GLS and BOU Express, depending on the destination region. The times indicated are estimates and may vary depending on external factors.

Upon receipt of the order, the customer must check the condition of the packaging and the products. In case of damage during transport, the customer must report the situation within 48 hours, sending photographs of the damage to info@quick-spirits.com.

7. Right of Withdrawal

Under Article 10 of Portuguese Decree-Law No. 24/2014, of 14 February, which transposes Directive 2011/83/EU on distance contracts, the consumer has the right to withdraw from the contract within 14 (fourteen) days from the date of receipt of the goods, without the need to indicate any reason and without any penalty.

This right applies to all items, including those purchased on promotion.

How to exercise the right of withdrawal:

1.Communicate the decision of withdrawal in writing to info@quick-spirits.com, indicating the order number. The consumer may use the model withdrawal form provided in Annex B of Decree-Law No. 24/2014, although its use is not mandatory.
2.Return the product(s) in their original condition, unopened, with the label and capsule/seal intact, within a maximum of 14 days from the communication.
3.The direct costs of returning the goods are borne by the customer.

The refund will be made within a maximum of 14 days after receipt and verification of the returned product(s), using the same payment method, and Quick-Spirits may delay this refund until receipt of the returned goods or proof of their dispatch.

Excluded from the right of withdrawal are products which, for reasons of health protection or hygiene, have been opened or whose seal/capsule has been removed or damaged after delivery.

8. Legal Warranty of Conformity

All products sold by Quick-Spirits benefit from the legal warranty of conformity provided for in Portuguese Decree-Law No. 84/2021, of 18 October, for a period of 3 years from delivery. In case of non-conformity, the customer has the right to restore conformity through repair or replacement of the goods, price reduction or termination of the contract.

9. Alternative Dispute Resolution (ADR) and Complaints Book

Under Portuguese Law No. 144/2015, of 8 September, in case of a consumer dispute, the consumer customer may resort to the following Consumer Alternative Dispute Resolution Entity:

10. Liability

Quick-Spirits makes every effort to ensure the quality and accuracy of the information made available on the website. However, it is not responsible for any errors, omissions or outdated content presented.

Excessive alcohol consumption is harmful to health. Drink responsibly.

11. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Portuguese law. For the resolution of any disputes, the courts of the Cascais judicial district shall have jurisdiction, without prejudice to consumer rights provided by law nor to the Alternative Dispute Resolution means indicated in point 9.
